These Terms & Conditions ("Terms") govern the use of the Wohna platform ("Platform") operated by Wohna FlexKapG ("Wohna", "we", "us", or "our").
By accessing or using the Platform, creating an account, or using any services, you agree to these Terms.
1. About Wohna
Wohna operates a digital rental platform that enables renters and providers (landlords, agents, property managers) to:
- Discover & book rental properties
- Communicate and manage booking requests
- Complete payments
- Generate and sign rental contracts digitally
Important:
- Wohna acts solely as a platform facilitator and provider of digital services.
- Wohna does not act as a landlord, property owner, property manager, or representative of either party.
- Wohna does not negotiate rental terms on behalf of users and does not provide legal, financial, or real estate advice.
- Wohna is not a party to rental agreements concluded through the Platform.
- All rental agreements are concluded directly between renters and providers.
2. Eligibility & User Accounts
To use the Platform, users must:
- be at least 18 years old;
- have the legal capacity to enter into binding agreements; and
- provide accurate, complete, and current information.
Certain Platform features require registration. Users are responsible for:
- maintaining the confidentiality and security of their account credentials;
- all activities carried out through their account; and
- promptly notifying Wohna if they become aware of unauthorized access to their account.
Each user may maintain one account unless otherwise agreed by Wohna.
Users must not create accounts using false identities, impersonate another person or organization, or use the Platform for fraudulent, unlawful, or abusive purposes.
Where a user acts on behalf of a company, property owner, landlord, or other organization, that user represents that they have sufficient authority to act on its behalf.
Wohna may restrict, suspend, or terminate accounts where reasonably necessary for security, fraud prevention, compliance with these Terms, legal obligations, or protection of other users.
3. User Roles
Users of the Platform may include:
- Renters
- Landlords and property owners
- Real estate agents and property management companies
- Student housing, co-living, and serviced living providers
Different features may apply depending on user role.
4. Platform Communication & Chat
Wohna provides an in-platform messaging system that allows users to communicate directly in connection with listings, booking requests, and rentals.
Users must not use the messaging system to:
- engage in harassment, threats, spam, fraud, or unlawful activity;
- impersonate another person or misrepresent material information;
- distribute malicious or harmful content; or
- attempt to misuse or circumvent Platform security.
Wohna may process and, where reasonably necessary, review communications for purposes including customer support, fraud prevention, safety, dispute resolution, enforcement of these Terms, and compliance with legal obligations. Wohna may restrict messaging functionality or suspend accounts where reasonably necessary for these purposes.
5. Listings & User Content
5.1. Listings
Providers are solely responsible for the listings they publish or make available through the Platform.
Providers must ensure that:
- all listing information is accurate, complete, current, and not misleading;
- prices, fees, deposits, availability, rental periods, property characteristics, and other material information are correctly stated;
- photographs, videos, descriptions, floor plans, and other materials accurately represent the property;
- they have the legal authority and all necessary rights, permissions, licenses, and approvals to offer the property for rent and to publish the listing;
- the rental offer and listing comply with applicable laws and regulations; and
- availability and other material listing information are updated within a reasonable time when circumstances change.
Providers must promptly update, pause, or remove listings that are no longer available or where material information has changed. Wohna may review, moderate, edit the presentation of, pause, reject, or remove listings where reasonably necessary for quality, security, compliance, technical, or legal reasons.
Any review, verification, badge, or other check performed by Wohna is intended to improve trust and platform quality. It does not constitute a guarantee by Wohna regarding:
- the accuracy or completeness of a listing;
- continued availability of a property;
- the condition, quality, legality, or suitability of a property;
- the identity, authority, or conduct of a provider; or
- whether a property will meet a renter's individual requirements.
Renters remain responsible for reviewing listing information and rental terms before entering into a rental agreement.
5.2. User Content
Users retain ownership of photographs, videos, descriptions, documents, text, reviews, and other content that they submit, upload, publish, or otherwise make available through the Platform ("User Content"). By providing User Content to Wohna, the user grants Wohna a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, publish, format, adapt, distribute, and otherwise use that User Content to the extent reasonably necessary to:
- operate and provide the Platform;
- display and distribute property listings;
- enable search, booking, communication, and other Platform functionality;
- improve the presentation and usability of listings;
- promote individual listings; and
- market and promote Wohna and its services.
This license applies for as long as the relevant User Content is made available through the Platform and, where reasonably necessary, for a limited period afterwards for previously created marketing materials, legal compliance, record-keeping, or technical backup purposes.
5.3. Marketing and Promotion of Listings
Providers expressly authorize Wohna to promote listings and listing content through Wohna's own channels and through third-party marketing, advertising, search, social media, and distribution channels. This may include, for example:
- search engines;
- social media platforms;
- online advertising;
- email and newsletter campaigns;
- Wohna's websites and applications;
- promotional campaigns;
- property recommendations;
- external distribution or marketing channels; and
- other reasonable promotional activities intended to generate renter interest or promote the Wohna Platform.
For these purposes, Wohna may use relevant listing information including property photographs, descriptions, location information, prices, availability, features, provider or property names where appropriate, and links directing users to the relevant listing or Platform. Wohna is not required to promote any listing and does not guarantee any level of exposure, inquiries, booking requests, or bookings resulting from such promotion.
5.4. Formatting and Adaptation of Listing Content
For Platform presentation and marketing purposes, Wohna may make reasonable technical or editorial adaptations to listing content. This may include:
- resizing or cropping photographs;
- adjusting image formats or dimensions;
- creating thumbnails;
- shortening or formatting descriptions;
- adapting content for different devices or marketing formats;
- adding Wohna branding, labels, pricing information, or calls to action; and
- creating promotional graphics or other marketing materials using listing content.
Wohna will not intentionally alter listing content in a way that materially misrepresents the property or rental offer. Material rental terms supplied by the provider, such as price, mandatory fees, availability, or rental conditions, will not intentionally be changed by Wohna for marketing purposes without authorization from the provider.
5.5. Rights to Content
Users may only upload, publish, or provide content for which they have the necessary rights and permissions. Providers represent that they have the necessary rights, licenses, consents, and permissions for Wohna to use listing content in accordance with this Section 5. This includes, where applicable, permission to use:
- professional property photographs;
- videos;
- floor plans;
- property descriptions;
- logos or branding;
- copyrighted materials; and
- other content supplied by third parties.
Users must not upload content that infringes intellectual property rights, privacy rights, personality rights, contractual obligations, or other rights of third parties.
If a user provides content belonging to another person or organization, the user is responsible for obtaining the necessary authorization before providing that content to Wohna.
5.6. Content Moderation and Removal
Wohna may reject, restrict, suspend, modify the presentation of, or remove User Content or listings where Wohna reasonably believes that the content:
- violates these Terms;
- violates applicable law;
- infringes third-party rights;
- is inaccurate, fraudulent, deceptive, or misleading;
- creates a security or safety risk;
- is inappropriate or abusive;
- relates to a property that is no longer available; or
- may harm the integrity, security, or proper operation of the Platform.
Where appropriate and reasonably practicable, Wohna may allow the user to correct the relevant information before removing or restricting the listing.
6. Requests to Book & Bookings
- A "request to book" is not a binding contract.
- Providers may accept or reject booking requests at their discretion.
- Wohna does not guarantee availability, acceptance, or completion of bookings.
Important:
- Providers may approve multiple booking requests simultaneously
- Approval of a booking request does not reserve or guarantee the property
- Approved booking requests may be time-limited
- A booking is confirmed only once the required payment is successfully completed
In case of multiple approved requests: the renter who completes payment first secures the property.
Once payment is completed:
- The booking is confirmed
- The contract process begins
7. Payments, Holding of Funds & Payouts
Certain services available through the Platform require payment.
Payments are processed through third-party payment service providers. Wohna does not itself provide regulated payment services and does not store users' full payment card details.
The amounts payable in connection with a booking, including rent, Wohna service fees, and any other applicable charges, will be presented to the renter before payment is completed.
Important:
Payments or financial arrangements made outside the Platform are not processed or protected by Wohna, and Wohna is not responsible for such transactions.
7.1. Payment Processing
Wohna integrates third-party payment services to facilitate payments connected with bookings and other Platform services.
Payment processing may therefore be subject to additional terms, verification requirements, restrictions, or processing rules imposed by the relevant payment service provider.
Wohna is not a bank, payment institution, escrow provider, or trustee.
7.2. Payment Protection and Delayed Payout
To support secure remote bookings, amounts paid by renters may be subject to delayed payout to the provider through Wohna's payment service provider.
The relevant funds may remain with or under the control of the payment service provider until the applicable payout conditions have been satisfied. Unless otherwise stated for a particular booking, renters have up to 48 hours after the scheduled move-in time to report a serious issue through Wohna. A serious issue may include, for example:
- inability to access the booked property;
- the booked property being materially different from the listing; or
- the booked property not being available as agreed.
Minor defects or differences that do not materially affect the renter's ability to occupy the property will not normally prevent payout. If no qualifying issue is reported within the applicable period, Wohna may instruct or permit the payment service provider to release the relevant amount to the provider.
7.3. Payouts to Providers
Provider payouts are processed through the applicable payment service provider. Wohna may instruct or request that a payout be delayed where reasonably necessary to:
- investigate a reported move-in issue;
- prevent suspected fraud;
- investigate a payment dispute or chargeback;
- comply with applicable law; or
- comply with requirements imposed by the payment service provider.
Exact payout timing may depend on the payment provider, banking systems, verification requirements, weekends, public holidays, and other circumstances outside Wohna's control.
8. Contracts & E-Signatures
Wohna may provide tools that enable renters and providers to prepare, generate, exchange, and electronically sign rental agreements.
Rental agreements are concluded directly between the renter and the provider. Wohna is not a party to the rental agreement unless expressly stated otherwise.
Providers remain responsible for ensuring that the rental terms and information they supply for a contract are accurate, lawful, complete, and appropriate for the relevant property and rental arrangement.
Renters are responsible for reviewing the rental agreement before signing it.
Where Wohna provides templates, automated document generation, or contract-related functionality, these tools are provided to facilitate the transaction and do not constitute legal advice or a guarantee that a particular agreement is suitable for every circumstance.
Electronic signatures may have legal effect under applicable law. Electronic signing services may be provided by third-party providers and may also be subject to their terms and conditions.
Once the rental agreement has been signed, the rights and obligations arising from the tenancy are governed by the rental agreement and applicable law.
9. Refunds & Cancellations
Cancellation and refund eligibility are subject to the cancellation policy applicable to the relevant booking. The applicable cancellation terms, including refundable and non-refundable amounts, will be presented to the renter before payment is completed.
9.1. Cancellation During the Applicable Cancellation Period
Before the applicable cancellation period has expired:
- A renter may cancel a confirmed booking in accordance with the cancellation policy applicable to that booking.
- Depending on when the cancellation occurs, the renter may be entitled to a full or partial refund of the first month's rent.
- Wohna service fees are non-refundable once the booking payment has been successfully completed, unless otherwise required by applicable law.
- Payment processing fees or other third-party charges may also be non-refundable where applicable and permitted by law.
9.2. Cancellation After the Cancellation Period Has Expired
If the applicable cancellation period has expired, the renter is no longer entitled to a refund under Wohna's booking cancellation policy, even if the rental contract has not yet been signed.
Where the rental contract has not yet been signed, any cancellation, refund, or alternative arrangement requested after the applicable cancellation period has expired must be agreed directly between the renter and the provider.
Wohna does not guarantee or determine whether a refund will be provided in such circumstances.
9.3. Cancellation After the Rental Contract Is Signed
Once the rental contract has been signed, Wohna's booking cancellation policy no longer applies.
Any cancellation, withdrawal, early termination, refund, or other rights or obligations relating to the tenancy are governed by:
- the rental contract concluded between the renter and provider; and
- applicable law.
Wohna is not a party to the rental contract and does not determine the parties' contractual termination or refund rights.
9.4. Failed Move-In or Serious Issues
Where a renter is unable to access the property or reports a serious issue within the applicable move-in protection period, Wohna may review the circumstances in accordance with Section 10 of these Terms.
Depending on the outcome of the review, Wohna may instruct or request its payment provider to refund, withhold, or release the relevant funds, where permitted by applicable law and the payment provider's terms.
9.5. Refund
Where a refund is approved, it will generally be processed through the original payment method.
The time required for the refunded amount to become available may depend on the payment provider, bank, card issuer, or other financial institution involved.
Nothing in this Section limits any cancellation, withdrawal, refund, or other rights that cannot be excluded or restricted under applicable law.
10. Disputes Between Users
Wohna is not a party to rental agreements between renters and providers. However, Wohna may assist users in resolving disputes relating to transactions carried out through the Platform.
Disputes may include, for example:
- inability to access a booked property;
- material differences between a property and its listing;
- booking or cancellation disputes; or
- disputes concerning payments processed through the Platform.
Users should first attempt to resolve the issue directly with the other party where reasonably possible.
Where Wohna reviews a dispute, Wohna may:
- request information, photographs, documents, or other evidence from either party;
- review relevant booking, payment, listing, and communication records; and
- instruct or request the payment service provider to delay payout while the matter is reviewed, where permitted.
Wohna may determine how its payment-protection process applies to the transaction based on the information reasonably available to it. Any such determination concerns the handling of payments through the Platform and does not determine the parties' legal rights under the rental agreement or applicable law.
11. Chargebacks & Payment Reversals
A renter may have rights to dispute a payment through their bank, card issuer, or payment service provider. Where a chargeback, payment dispute, or payment reversal occurs:
- the relevant transaction or payout may be suspended or reversed;
- funds may be withheld or recovered where permitted by the payment service provider;
- users may be required to provide information or evidence relating to the transaction; and
- Wohna may cooperate with the payment service provider in responding to the dispute.
The final decision regarding a chargeback may be made by the relevant bank, card issuer, card network, or payment service provider and may be outside Wohna's control.
12. Right to Reverse Transactions
Wohna may instruct or request its payment service provider to refund, reverse, cancel, or correct a transaction where reasonably necessary due to:
- an approved cancellation or refund;
- a qualifying move-in issue;
- fraud or suspected unauthorized activity;
- duplicate or erroneous payments;
- a chargeback or payment-provider requirement;
- compliance with applicable law; or
- another circumstance expressly permitted under these Terms.
Any refund, reversal, or correction remains subject to applicable law and the technical and contractual rules of the relevant payment service provider.
14. Reviews & Ratings
Users may submit reviews or ratings where enabled.
- Reviews reflect personal opinions
- Wohna does not guarantee accuracy or completeness
- Wohna may remove reviews that are abusive, misleading, or unlawful
15. Platform Availability & Modifications
Wohna aims to provide a reliable and secure Platform but does not guarantee uninterrupted or error-free availability.
The Platform may occasionally be unavailable or restricted due to maintenance, updates, technical failures, security measures, third-party services, or circumstances outside Wohna's reasonable control.
Wohna may modify, update, suspend, or discontinue Platform features where reasonably necessary for technical, security, legal, commercial, or operational reasons.
Where a material change affects a paid service already purchased by a user, Wohna will provide any notice or remedy required under applicable law.
16. Limitation of Liability
Wohna provides the Platform as an intermediary digital service and does not control the conduct of renters, providers, or other users.
To the extent permitted by applicable law, Wohna is not responsible for losses arising solely from:
- inaccurate or misleading information supplied by users;
- the condition, legality, availability, or suitability of properties offered by providers;
- acts or omissions of renters, providers, landlords, agents, or other third parties;
- rental agreements concluded between users;
- transactions or communications carried out outside the Platform; or
- failures or interruptions caused by third-party services or circumstances outside Wohna's reasonable control.
Nothing in these Terms excludes or limits Wohna's liability where liability cannot legally be excluded or limited, including liability arising from intentional misconduct or other mandatory statutory liability.
For consumers, any statutory rights and remedies under applicable consumer protection law remain unaffected.
17. Suspension & Termination
Users may close their account subject to any outstanding bookings, payments, contracts, disputes, or legal obligations. Wohna may restrict, suspend, or terminate access to the Platform where reasonably necessary because of:
- a material or repeated breach of these Terms;
- fraud or suspected fraudulent activity;
- misuse of the Platform;
- risks to other users or Platform security;
- non-payment of amounts due to Wohna; or
- legal or regulatory requirements.
Where reasonably appropriate, Wohna may provide notice or an opportunity to remedy the relevant breach before termination.
Suspension, account closure, or termination does not affect rights or obligations that arose before termination, including obligations relating to confirmed bookings, payments, refunds, disputes, or rental agreements.
18. Privacy & Data Protection
Personal data is processed in accordance with our Privacy Policy and Cookie Policy.
19. Governing Law & Jurisdiction
These Terms are governed by Austrian law.
Where the user is a consumer, this choice of law does not deprive the user of any mandatory consumer protection rights available under the law that would otherwise apply.
Jurisdiction shall be determined in accordance with applicable law. Any mandatory consumer jurisdiction rules remain unaffected.
20. Changes to These Terms
Wohna may update these Terms where reasonably necessary, including to reflect changes to the Platform, business model, technology, security requirements, or applicable law.
The latest version will be made available on the Platform.
